THIS IS A SAFETY NOTICE WITH CONDITIONS THAT MAY AFFECT YOUR LEGAL RIGHTS


Everyone entering LOIS Parking Ltd car parks is bound by the following Terms and Conditions.

1. Definitions


“Car Park”
means all and any car parks operated and managed by Lois Parking Ltd.

“Company”
means LOIS Parking Ltd.

“Customer”
means any person who uses the Car Park whether by him or herself, or his or her servants or agents or
as servant or agent for anybody else and any person having any propriety, possessors, financial or material interest in the vehicle entering the Car Park.

“Entrant”
means any natural person who enters or is in the Car Park, irrespective of whether or not he or she is a Customer.

Except where expressly qualified person includes companies, firms and associates incorporated or un-incorporated; and words in singular shall where applicable include the plural and words incorporating a masculine meaning shall include a feminine and neuter meaning.

2. Liabilities of the Company


All Entrants enter the Car Park at their own risk and neither the Company nor any person acting on its behalf is in any way responsible for any loss, injury or damage sustained by them or for loss or damage to vehicles and their contents left within the Car Park. This does not exclude liability caused by the Company’s negligence or other breach of duty of the Company and/or its servants and/or its agents.

3. Claims and complaints procedure


If a vehicle is damaged in any way whilst in the Car Park, or should any loss of vehicle or loss of any personal possessions from the vehicle occur, whilst it is in the Car Park, please:
 

a. immediately inform the Company and/or any member of its staff;
b. report any incident of theft to the police; and
c. notify your insurers promptly.


If any damage, loss or injury is suffered, the Company should be notified before the vehicle is removed from the premises.

Any complaints about the services of the Company in circumstances where any damage, loss or injury is suffered, should be made to the information desk or via email to info@loisparking.com or via the Company’s website www.loisparking.com. All communications must be directed to LOIS Parking Ltd, 10 Prince Charles Street, Ayios Dometios 2372, P.O. BOX 24360, 1703 Nicosia, Cyprus.

4. Security of vehicles


Before leaving the vehicle please ensure that:

  • your vehicle is locked and all windows securely closed;
  • the handbrake is applied;
  • if your vehicle is fitted with a steering wheel lock or similar device, that it is engaged;
  • no person or animal is left in the vehicle;
  • any security lock is properly engaged and alarm system activated;
  • you take all possessions with you when leaving the vehicle. If this is not possible, any and all such possessions should not be left where they are visible from the outside; and
  • you carry your ticket with you.


5. Safety in the Car Park


When driving in the Car Park you must:

  • drive carefully and safely;
  • abide by the usual rules of the road and obey the directions displayed on all markings, notices and signs;
  • keep a watchful eye for pedestrians and young children using the car park; and
  • comply with all instructions or requests given by any of the Company’s employees, or anyone authorised to act for the Company, for controlling and the positioning of vehicles within the Car Park.


Further guidelines:

  • maximum speed limit in the Car Park is 10km per hour;
  • maximum height limit in the Car Park is 2.05m;
  • children must not play in the car park and must not be left unaccompanied;
  • you must not remain in your vehicle in the Car Park except for the purposes of parking or removing your vehicle;
  • once the vehicle is parked please make your way to the nearest exit, and beware of moving vehicles; and
  • you must not under any circumstances exit the Car Park by walking under a vehicle exit barrier.


6. CCTV


Where CCTV cameras are installed in the Car Park they are used to assist in the proper running of the Car Park. The CCTV cameras may also act as a deterrent to criminal activity. We are obliged to display signage in the Car Park advising that CCTV cameras are in operation. However, we do not make any representation as to the extent of coverage provided by the cameras and no guarantee is given as to the security of your vehicle in the Car Park where CCTV is installed.

7. Courtesy to other Customers


If you damage another Customer’s vehicle, you should report the matter to the Company and/or to one of our employees as soon as possible. You will be asked to give one of our employees the registration number of both vehicles, your full name and address and the name and address of your vehicles‘ insurance company, together with your policy number, who will then communicate such details to the owner of the other vehicle.

8. Damage to other property in the Car Park


If you damage any property or structure within the car park, will be liable and you must tell one of our employees as soon as possible. You may be required to repair the damage (to our reasonable satisfaction), or to pay the reasonable costs that we have to pay to repair the damage.

9. Prohibited activities


The following activities are prohibited and not allowed within the Car Park:

(a) vehicles cannot be towed or pushed into the Car Park. The only way that vehicles are allowed to enter into the Car Park is by being driven in;

(b) you are not allowed to carry out or authorise anyone else to carry out any work, maintenance or repairs to your vehicle whilst it is in the Car Park, except where such service is provided by the Company and/or its collaborators. In the event of vehicle breakdown you must contact the Company and/or its employees immediately;

(c) you are not allowed to wash or clean or authorise anyone else to wash or clean your vehicle whilst it is in the Car Park, except where such service is provided by the Company and/or its collaborators;

(d) you are not allowed to sell or hire out your vehicle, or do anything which is connected with the sale or hire of your vehicle, whilst it is in the Car Park, except where such service is provided by the Company and/or its collaborators;;

(e) you are not allowed to park your vehicle anywhere that could cause obstruction to other Car Park users, whether this be by blocking the entrance/exit or by causing an obstruction inside the Car Park;

(f) you are not allowed to park within a bay designated for a specific purpose when you are not entitled to do so (e.g. parking in a space for the disabled without an appropriate disability badge displayed);

(g) you are not allowed to park over more than one parking space, you should make sure that your vehicle is parked fully within a parking space;

(h) you are not allowed to do anything in the car park which may annoy other users of the Car Park, or which may cause offence or inconvenience to us or any other user of the Car Park;

(i) you are not allowed to dispose of any items in the Car Park. Please place any rubbish in the bins that are provided;

(j) you are not allowed to pour petrol, or any other fuel, into your vehicle whilst it is in the Car Park. You are also not allowed to take petrol, or any other fuel, out of your vehicle whilst it is in the Car Park;

(k) smoking is forbidden within the Car Park; and

(l) you must not do anything in the Car Park which would be a breach of the law.


10. Moving and relocation of vehicles


The Company, and any persons authorised to act for the Company, have the right to move any vehicles either to another parking space inside the car park or to public roads, by whatever method it considers reasonable, in the following circumstances:
 

(a) If the Company or anyone authorised to act for the Company, reasonably believe that a vehicle is causing a serious obstruction in the Car Park or that is reasonably necessary for the purposes of safety to persons or property in the Car Park.

(b) If part of, or the whole Car Park has to be closed (either permanently or temporarily), or if the Car Park has to be evacuated, either in the case of an emergency or for other reasons, we have the right to refuse access to the Car Park and/or move any vehicle to another one of our car parks.

Vehicles will be moved as more reasonably convenient for Customers as possible.

11. Abandoned vehicles


Any vehicle left in the car park for more than 5 days, for which prior notification has not been given to the Company, may be considered abandoned. The Company reserved the right to dispose of any vehicle it reasonably believes to have been abandoned. Before disposing of abandoned vehicles the Company will make reasonable enquiries to identify and contact the registered owner of the vehicle.

12. Tickets


Tickets are non-transferable and only valid for the vehicle in respect of which it is issued. Tickets are only valid for one entry and one exit at any one time. The ticket cannot be used in respect of a second vehicle or Car Park user.

If you cannot produce your ticket on departure from the car park, you will have to pay the penalty displayed on the tariff board.

13. Seasonal/Proximity card


Seasonal/proximity cards are available for Customers or any other person wishing to make a regular use of the Car Park. The following procedure must take place for obtaining of a seasonal/proximity card:

  • interested persons can obtain a seasonal/proximity card after completion of the Seasonal/Proximity card Application Form which is available at the information desk of the Car Park;
  • the Seasonal/Proximity card Application Form should be completed and signed and returned at the information desk;
  • applicants will be informed once their request for a seasonal/proximity card is accepted, and the seasonal/proximity card will be available at the information desk of the Car Park for collection; and
  • once the seasonal/proximity card is collected payment can be made at the top-up machines that are in place in the Car Park.


Submission of the Seasonal/Proximity card Application Form as described above is considered as an offer from the applicant to the Company to enter into a contract for the opportunity to park in accordance with this clause 13. By making an offer the applicant is deemed to have confirmed that:

  • all the information provided in the Seasonal/Proximity card Application Form is correct;
  • if a natural person, is at least 18 years old; and
  • if a legal person, all holders of a seasonal/proximity card will comply with these terms and conditions; and
  • is legally capable of entering into biding contracts.


Holders of seasonal/proximity cards must comply with the following additional conditions:
 

(a) A deposit of €20 will be required on collection of the seasonal/proximity card. Such deposit will be returned to the seasonal/proximity card holders on its expiry or on its cancellation (if applicable) after returning same at the information desk.

(b) Payment of the seasonal/proximity card will be made based on the discounted prices applicable for seasonal/proximity cards from time to time. Such prices may be changed at any time. Such price changes will be notified to the seasonal/proximity cards holders in writing and will take effect from the next top up of their seasonal/proximity card.

(c) Provision of relevant personal information will be required when applying for a seasonal/proximity card. In such circumstances, we shall not disclose any of the personal information provided to any third party and will limit access to such personal information to employees and any of our collaborators who we reasonably believe need access to that information to provide their services. We may disclose personal information if required to do so by law or if we believe that such action is necessary to protect and defend the rights, property or personal safety of the Company or any of Customers.

(d) If any seasonal/proximity card holder wishes to renew his/her seasonal/proximity card, this must be done before its expiry at the top-up machines that are in place in the Car Park. If no such renewal is made, any further use of the Car Park will be charged at the tariffs displayed on the tariff boards.

(e) Seasonal/proximity cards are valid only for the Car Park and the period shown on the ticket receipt, or as otherwise agreed with us in contract.

(f) We reserve the right at any time to close either permanently or temporarily the Car Park for which the seasonal/proximity card is valid.

(g) Seasonal/proximity cards are not transferable without prior written consent from us, such consent may be refused at our sole discretion.

(h) We are entitled to cancel any seasonal/proximity card at any time. In such an event, we will refund the value of the unused part of the period relating to the relevant seasonal/proximity card, unless such cancellation occurs as a result of a breach of any of these Terms and Conditions by the seasonal/proximity card holder.

(i) No credits or refunds are given other than for total cancellation of the seasonal/proximity card by us where the seasonal/proximity card holder is not at fault. No credits are given for periods of non-use in the course of the validity of a seasonal/proximity card.

(j) A replacement seasonal/proximity card will only be issued on receipt of written confirmation of its loss or damage after completion of the relevant Lost Ticket form available at the information desk. A further deposit will have to be given for the replacement seasonal/proximity card.

(k) The seasonal/proximity card does not guarantee a parking space or a designated parking space.

(l) The seasonal/proximity card does not grant exclusive possession or any form of lease, licence or other property right in respect of the Car Park.


14. Tariff


The prices for using the car park will be displayed on the tariff boards within the Car Park and Customers will be charged for the length of time that their vehicle remains in the Car Park at the prices shown on the tariff boards. The Company reserves the right to vary the tariff without notice.

15. Penalties


If you park your vehicle in the Car Park, but do not comply with or breach these Terms and Conditions a clamp may be put on one of the wheels of your vehicle. You will have to pay to have the clamp removed. The Company accepts no responsibility for any losses suffered or costs incurred by you as a result of the clamping.

16. Agency


Every person who enters into an agreement with us for the parking of a vehicle at this car park whether by purchasing a ticket or otherwise does so on behalf of themselves and all other persons who have legal rights in the vehicle and any of its contents.

17. Variations of the terms


These Terms cannot be varied unless the Company expressly agrees to the variation in writing.

18. Third party rights


These Terms do not create any right enforceable by any person other than the Customer, the Entrants or the Company.
